Terms of supply
Last reviewed 1 July 2026. These conditions apply to all trade supply unless varied in writing.
1. Application
These conditions govern all supply by Mallikarjuna Stones Ltd, company number 17314931, to trade buyers. They prevail over any terms put forward by the buyer unless varied in writing and signed by a director.
2. Quotations
Quotations are valid for 30 days from issue and are given per square metre for each stone, finish and thickness stated. Pricing is offered to the buyer's nearest port or delivered to the buyer's yard, on request. All handling is stated on the face of the quotation.
3. Orders and minimums
The minimum order is one 20 ft container per stone and finish. Mixed-stone containers are accepted from 120 m² per line item. An order is confirmed on receipt of a written purchase order and the agreed deposit.
4. Natural variation
Shahabad limestone is a natural material. Colour, marking and surface character vary within and between benches. Samples and photographs indicate the general character of the stone and are not a guarantee of exact match. Where colour continuity across phases is critical, the buyer should reserve material against a named bench before the order is placed.
5. Tolerances
Calibrated material is supplied to ± 1.0 mm on thickness for sizes to 600 × 600 mm and ± 1.5 mm above that size. Natural riven material is supplied at 18–24 mm nominal with ± 3.0 mm variation. Supply allowances for cutting and transit are 3 per cent on calibrated material and 5 to 7 per cent on random riven, as stated per stone.
6. Inspection and claims
Consignments must be inspected within 7 days of discharge at the buyer's premises. Claims for shortage, damage or non-conformity must be notified in writing within that period, quoting the crate marks and batch identifier, with photographs of the material as received.
No claim is accepted for material that has been cut, fixed or otherwise incorporated into the works.
7. Documentation
Each shipment is supplied with a declaration of performance for each stone type, a batch test summary referenced to the crate marks, a packing list and the ISPM 15 crating declaration.
8. Delivery and delay
Lead times quoted are estimates based on current sailing schedules. We are not liable for delay caused by port congestion, vessel omission, customs inspection or any cause beyond our reasonable control, but we will notify the buyer of a known delay within one working day of becoming aware of it.
9. Payment and title
Unless otherwise agreed in writing, payment terms are 30 per cent on order confirmation and the balance against shipping documents. Title passes on receipt of cleared funds in full. Risk passes in accordance with the delivery basis stated on the quotation.
10. Liability
Our liability in respect of any consignment is limited to the invoice value of the material affected. Nothing in these conditions excludes liability for death or personal injury caused by negligence, or for fraud.
11. Governing law
These conditions and any dispute arising from them are governed by the law of England and Wales, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
